H4 EAD : I-765 – Q 18 Eligibility Category : Amendment H1 b Receipt number (in progress not approved yet) or previous approved H1-b Receipt number.
I have approved i539 (H4- Application to extend/ change nonimmigrant status) till 08/13/2016 however, my spouse employer submitted amendment petition for h1-b (i-129 Petition for a nonimmigrant worker) on aug-2015 and it is still in progress.
I ‘m applying for h4-ead based on approved i-140 (6-Jan-2016) however, I’m not sure what receipt number on form i-765(h4-ead) for question number 18 I have to fill . Approved one or Amendment petition which is still in progress.

You need to provide the amended receipt number. EAD approval would depend upon approval of the amendment. Would also advise to get H1 amendment upgraded to premium to get a faster response.

I am also in same situation like you. I guess your h1b is gone once you had i539 approval, now you are in H4. So h1b amendment will be denied anyway.

I am interested to know what happend with your case.

I am applying h4-cos for my wife but her h1b amendment is in process. So i am confused too what USCIS will do
